Tip 1 Get informed about the LMNP status
Before you start your tax return, make sure you understand the status of Loueur en Meublé Non Professionnel. This scheme concerns people who rent furnished accommodation without making it their main activity and whose rental income does not exceed €23,000 per year or does not represent more than 50% of their overall income.
Tip 2 Choose the right tax regime
As a LMNP, you can opt for two tax regimes: the micro-BIC regime or the simplified real regime. The micro-BIC regime is the simplest and is suitable for rental income of less than €77,700 per year. It allows you to benefit from a flat-rate deduction of 50% for your expenses. The simplified real regime is more complex but can be advantageous if your expenses exceed the flat-rate deduction of 50%. This allows you to deduct expenses related to the management and maintenance of the property, such as work, management fees, loan interest, etc.
Advice 3 Gather your documents and information
To make your LMNP tax return, you will need the following documents:
- Rental contract and proof of rent received;
- Invoices for expenses related to the rental (management fees, insurance, maintenance, etc.);
- Depreciation of the property and furniture (if you have opted for the simplified real estate regime).
Tip 4 Fill out the necessary forms
Depending on the tax system you have chosen, you will have to fill out different forms:
- Micro-BIC regime: form 2042-C PRO, heading "Non-professional industrial and commercial income - Micro-enterprise";
- Simplified real system: form 2031 and its annexes (2033-A to 2033-G).
Advice 5 Don't forget the declaration of existence
When you start your LMNP activity, you must fill in the declaration of existence (form P0i) via the " guichet des formalités des entreprises". This declaration will allow you to obtain a SIRET number and to register for the appropriate tax regime.
Tip 6 Respect the deadlines
The deadlines for filing your income tax return vary depending on your geographical location and whether you file online or on paper. Make sure you meet these deadlines to avoid penalties. Depending on your department of residence, the deadlines are broken down into three zones:
- zone 1: Thursday, May 25, 2023 at 11:59 p.m. for departments 01 to 19 and non-residents;
- zone 2: Thursday, June1, 2023 at 11:59 p.m. for departments from 20 to 54;
- Zone 3: Thursday, June 8, 2023 at 11:59 p.m. for departments from 55 to 974/976.
